OM Quick Ship Ja Limited

1. SERVICE DESCRIPTION

1.1 Overview

OM Quick Ship Ja Limited (“the Company”) provides international courier and logistics services, including air freight, sea freight, package collection in Mandeville Town, and personal home delivery to Knockpatrick District and surrounding areas.

1.2 Service Types

- Air & Sea Freight: Importation of packages from global origins into Jamaica via commercial or consolidated shipments.

- Local Collection: Customers may collect packages at our designated Mandeville Town collection point during operating hours.

- Home Delivery: Personal home delivery service available within and around the Knockpatrick District at a fee of JMD $500 per delivery.

1.3 Global Coverage

The Company accepts shipments from any country worldwide, subject to Jamaican customs regulations and carrier restrictions.

2. CUSTOMER RESPONSIBILITIES

2.1 Proper Packaging

Customers must securely package all items to withstand normal handling during international transit and local delivery. The Company is not liable for damage caused by inadequate packaging.

2.2 Accurate Documentation

Customers must provide complete, truthful, and accurate shipping details, including sender/recipient information, item description, value, and origin. False declarations may result in seizure, fines, or service denial.

2.3 Prohibited & Restricted Items

Customers agree not to ship items prohibited under Jamaican law, including but not limited to:

- Firearms, ammunition, or weapons

- Illegal drugs or narcotics

- Perishable food (unless specially permitted)

- Flammable, explosive, or hazardous materials (e.g., lithium batteries not in compliance with IATA)

- Counterfeit goods, pornography, or items violating intellectual property rights

- Live animals or plants without proper permits

All prohibited items are governed by the Customs Act of Jamaica, Dangerous Goods (Air and Sea) Regulations, and directives from the Jamaica Customs Agency (JCA). The Company reserves the right to inspect, refuse, or dispose of non-compliant items without notice or compensation.

3. COMPANY RESPONSIBILITIES

3.1 Standard of Care

The Company will exercise reasonable care in handling, transporting, and delivering packages in accordance with industry standards.

3.2 Delivery Commitments

- Once a package is marked “ready for pickup” in our system, delivery or availability for collection will occur within 1–2 business days.

- Home delivery is limited to the Knockpatrick District unless otherwise arranged in writing.

- The Company is not responsible for delays caused by customs clearance, incorrect addresses, recipient unavailability, or force majeure events (see Section 8).

4. PRICING AND PAYMENT

4.1 Fee Structure

- Base Shipping Rate: JMD $550 per pound (actual or dimensional weight, whichever is greater)

- Processing Fee: JMD $150 per package

- Home Delivery Fee: JMD $500 per delivery (Knockpatrick District only)

4.2 Additional Charges

Customers may incur extra fees for:

- Customs duties, taxes, or brokerage (payable to Jamaican authorities)

- Storage beyond 15 days: JMD $100 per day per package

- Failed delivery attempts due to customer error

4.3 Payment Terms

- All fees must be paid in full prior to delivery or collection.

- Payments accepted via cash, bank transfer, or approved mobile payment platforms.

- Accounts unpaid after 7 days may be subject to suspension or collection action.

5. LIABILITY AND INSURANCE

5.1 No Insurance Offered

The Company does not provide insurance for shipped items. Customers ship at their own risk.

5.2 Liability Limit

The Company’s maximum liability for loss, damage, delay, or misdelivery is limited to JMD $15,000 (or USD $100 equivalent) per package, regardless of actual value. This limit applies even in cases of negligence.

5.3 Claims Process

To file a claim:

- Notify the Company in writing within 48 hours of delivery or scheduled delivery date.

- Provide proof of value (e.g., receipt, invoice).

- Claims not submitted within 48 hours are void.

- No claims accepted for prohibited, undeclared, or improperly packaged items.

6. PROHIBITED ITEMS

(See Section 2.3 for full list)

Customers acknowledge that shipping prohibited items constitutes a breach of these Terms and may result in legal reporting to Jamaican authorities.

7. DELIVERY TERMS

7.1 Timeframes

Delivery time begins only after a package is cleared by Jamaican customs and marked “ready for pickup” in the Company’s tracking system. Standard local delivery: 1–2 business days thereafter.

7.2 Failed Deliveries

If a delivery attempt fails due to:

- Recipient unavailability

- Incorrect address

- Refusal to pay fees

The package will be held for 15 calendar days at the Mandeville collection point. After 15 days, storage fees apply. Unclaimed packages may be disposed of after 30 days.

8. FORCE MAJEURE

The Company is not liable for delays or failures caused by events beyond its reasonable control, including but not limited to:

- Natural disasters, hurricanes, or extreme weather

- Strikes, riots, or civil unrest

- Government actions, customs inspections, or regulatory changes

- Airline, port, or carrier disruptions

- Pandemics or public health emergencies

In such cases, the Company will use reasonable efforts to resume service but offers no refunds for force majeure delays.

9. DISPUTE RESOLUTION

9.1 Governing Law

These Terms are governed by the laws of Jamaica.

9.2 Resolution Process

- Customers must first contact the Company via email (**[email protected]**) to resolve complaints.

- If unresolved within 14 days, parties agree to mediation in Kingston, Jamaica.

- If mediation fails, disputes shall be settled exclusively in the courts of Jamaica.

10. PRIVACY AND DATA PROTECTION

10.1 Data Use

Customer contact, shipping, and payment information is collected solely to provide services, comply with customs requirements, and improve user experience.

10.2 Compliance

The Company adheres to Jamaica’s Data Protection Act, 2020. Personal data is not sold or shared with third parties except as required by law (e.g., the Jamaica Customs Agency).

10.3 Tracking & Communication

Customers may receive SMS or email updates. Opt-out options are available upon request.

11. MODIFICATION OF TERMS

The Company reserves the right to update these Terms at any time. Revised Terms will be posted on [www.omquickshipjaltd.org](http://omquickshipjaltd.org) with an updated “Effective Date.” Continued use of services constitutes acceptance.

12. TERMINATION

12.1 By Customer

Customers may discontinue services at any time by ceasing to use the Company’s services.

12.2 By Company

The Company may suspend or terminate service for:

- Violation of these Terms

- Fraudulent activity

- Repeated non-payment

- Shipping prohibited items

Outstanding fees remain payable upon termination.

13. REFUND POLICY

13.1 Eligibility

Refunds are issued only if:

- A package is confirmed lost or unaccounted for by the Company after investigation

- A customer is double-charged due to a system error

13.2 Exclusions

No refunds for:

- Customs delays

- Force majeure events

- Customer error (e.g., wrong address)

- Packages held in storage

13.3 Processing

Approved refunds will be issued within 14 business days via the original payment method or bank transfer.

These Terms and Conditions constitute the entire agreement between the Customer and OM Quick Ship Ja Limited and supersede all prior communications. By using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
